Collaborative Law
Collaborative law is a recent development in the area of Family Law which attempts to resolve marital disputes and differences – whether separation or divorce – in a dignified and amicable manner and without the necessity of court proceedings.
The benefits of this new process is that parties are allowed to discuss the various which may arise in an open and friendly manner and outside the context of normal family law proceedings.
The role of a Solicitor engaged in this process is to assist parties in the resolution of their differences and thus achieve a speedy and workable solution without the normal stress and upset which accompanies family disputes.
Ann Nowlan has previously qualified as a Collaborative Lawyer and is thus well equipped and experienced to assist parties in the resolution of their differences.
The following is a guideline as to how the collaborative law process works. For further information on any aspect of this new and innovative development please contact Ann Nowlan.
- You and your partner each instruct a specialist collaborative family Solicitor
- You both agree with your Solicitor to work together as a team and to resolve issues without the necessity of court proceedings
- There is an honest and open disclosure of all information - financial and otherwise
- Experts such as accountants /psychologists can be enlisted to help as part of the team
- Settlement is reached in four way, ‘face to face’ meetings (2 parties and 2 Solicitors)
- You and your partner remain in control of the collaborative process
- Your Solicitors are present to provide support legal advice and guidance
- If no settlement is reached, new Solicitors will have to be instructed for family law legal proceedings
