We have found over the years that businesses and private individuals often have
An extreme reluctance to pursue the recovery of a debt. It is often felt that there is no use in “throwing good money after bad”.

However the recovery of a debt can often be a straightforward matter once the correct procedure is followed in a timely manner.

Once instructions are received from a client:-

  1. We write to the person/company who owes the money seeking payment. If a proposal is made in response we will take our clients instructions and quite often the matter does not have to go further.
  2. If no response is revived legal proceedings are commenced immediately. Quite often after these proceedings are served a proposal for payment is made and once again the matter may be concluded with no further action having to be taken.
  3. Once the Court date is obtained application will be made for Judgement. The Court Order will then be served on the Debtor and thereafter further steps can be taken to enforce the debt- Bankruptcy; Registration of a debt on property; and Instalment Orders.; Execution Orders.

In order to proceed with a claim as speedily as possible we require the following:-

  1. The correct name/title of the person/company and their address. A Trade or Business name is not sufficient.
  2. A statement showing clearly how the amount is calculated together with (where appropriate) a copy of any loan agreement, Purchase Order or Invoice.
  3. A statement showing any previous payments made.
  4. If payment was previously made by cheque which has been either cancelled or dishonoured a copy of this cheque. The original will subsequently be required.
