Employment Law

This is an area of law which has developed considerably over the last ten to fifteen years. It is also an area of law which has daily application in workplaces throughout Ireland.

The most common areas which are familiar to most people are the following:-

  1. Unfair Dismissals.
  2. Constructive Dismissals.
  3. Minimum Notice and Terms of Employment.
  4. Redundancy selection .
  5. Holiday Act entitlements.

However there are also many other important areas which concern the relationship between employers and employees and how that relationship is regulated - sexual discrimination; ageism; bullying and stress in the workplace.

A great many of the difficulties in these areas can be avoided by the proper drafting and implementation of Employment Contracts. It is for this reason that we will always recommend to employers that not only is it important to have such contracts prepared for all employees but also that the implementation of the terms of the contract are properly administered and recorded. 

We at Burns Nowlan have extensive experience of all areas of Employment Law and can advise on the drafting and interpretation of Employment Contracts. We have also represented both employers and employees at the Labour Court, hearings before Rights Commissioners and the Employment Appeals Tribunal.
