Personal Injury Claims

These type of claims normally arise in circumstances where a person has received injuries as a result of an accident and for which they are not responsible. The accident will more often than not have occurred either while driving a car operating machinery or at work. Needless to say there are many factors involved in determining who is responsible for and accident and in certain cases the report of a Litigation Engineer may be needed before a final decision can be made as to whether or not to pursue a claim for compensation.

Our approach to such claims is firstly to take detailed attendances as to what exactly occurred as soon as possible from both the injured party and if at all possible any witnesses. If we find that there is a technical issue which has to be determined relating to the accident we will immediately retain the services of a litigation Engineer. This engineer will prepare a plan and detailed drawings of the scene of the accident will also take the appropriate photographs and will then prepare a detailed report on what occurred. We will also obtain Medical Reports from the various Doctors and where necessary the Consultant Surgeons from who medical treatment was sought.

Since the establishment of the Injuries Board all Personal Injury claims [ other than Medical Negligence ] must first be filed with them. The Injuries Board obtain their own medical reports and consider all documentation supplied by our office. If an assessment is made by them we will provide detailed advice as to whether the assessment should be accepted. If the assessment is not acceptable to a client Legal Proceedings can then be instituted.
